CONSULTING SERVICES – FIRMS SELECTION

CONSULTANCY SERVICES FOR PROVISION OF LEGAL/ CONVEYANCE SERVICES TO ENSURE PAPS SECURITY OF TENURE TO THE RESETTLEMENT LAND IN MWACHE DAM AREA, KWALE COUNTY

1. The Government of Kenya has received financing from the World Bank toward the cost of the Coastal Region Water Security and Climate Resilience Project (CRWSCRP) and intends to apply part of the proceeds from this financing for payment of Consulting Services for provision of legal/conveyance services to ensure Project Affected Persons (PAPs) security of tenure to the resettlement land in Mwache Dam area, Kwale County; Contract No: MOWSI/KWSCRP-2 /003/2021-2022.
2. The objective of the assignment is to offer all needed legal/conveyance services that are intended to give the reset­tling and resettled Project Affected Persons (PAPs) land transfer & transaction services. These services are intended to eventually give the resettled and resettling PAPs security of tenure in terms of title deeds for the new land they have already bought and resettled on and the new land that the additional PAPs will buy after their former and current land was and will be compulsorily acquired for the purpose of Mwache Dam Construction respectively. The output for this assignment will title deeds served to the Mwache PAPs for the land they have purchased or will purchase with compensation money paid for the project compulsorily acquired land.
3. The duration of the services is expected to be three (3) years.
4. The Ministry of Water, Sanitation and Irrigation now invites eligible legally registered Law firms (“Consultants”) to express their interest in providing the Services. Interested firms should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The short-listing criteria are:
5. a)Relevance and suitability of the applicant’s core business to the assignment
6. b)The consultancy firm should be a legally registered Law firm with at least 10 years of experience in undertaking public land related conveyances
7. c)The Consulting firm must be familiar with the relevant regulatory framework of the Government of Kenya and the relevant operational policies of the World Bank (specifically OP 4.12 and OP 4.10).
8. d)Technical and managerial capabilities and administrative and financial strength of the firm will be important aspects.

5. Attention of the interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Em­ployment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers January 2011 revised July 2014(“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.
6. Firms may associate in the form of a joint venture or a sub-consultancy to enhance their qualifications. The role of each partner in the association must be clear.
7. A Consultant will be selected in accordance with the Consultant Qualification Selection (CQS) method as set out in the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers, January 2011 revised July 2014 (“Consultant Guidelines”)
8. Interested consulting firms may obtain further necessary information at the address below during office hours be­tween 0900 to 1600 hours from Monday to Friday excluding lunch hour (1300 to 1400Hrs) and public holidays.
9. The completed expression of interest documents in writing in three (3) copies must be delivered to the Tender Box on Ground Floor, Maji House or sent to the address below as to be received on or before 27th April, 2022 at 1000 hours East Africa Time.
