REGISTRATION AND LICENSING OF PROCURING OR ASSET DISPOSAL AGENTS
The Public Procurement Regulatory Authority (the Authority) is established under Section 8 of the Public Procurement and Asset Disposal Act, 2015 (the Act). Section 51(3) of the Act as read together with Regulation 38 (1) of the Public Procure- ment and Asset Disposal Regulations, 2020 (the Regulations) mandates the Authority to register and license procuring or asset disposal agents (the Agents).
Procuring or asset disposal agents play a vital role in enhancing and supplementing capacity of procuring entities to com- ply with the Act, the Regulations and the directives of the National Treasury and the Authority. The agents are also vital in ensuring that public procurement and asset disposal system in Kenya fully complies with the fundamental principles of fairness, transparency, equity, competition and cost effectiveness as well as other guiding principles which include rule of law, accountability, good governance, sustainability, prudence, latest technology and international rules.
To operationalise the registration and licensing of the procuring or asset disposal agents, the Authority has developed guidelines for observance by the Authority, procuring entities and procuring or asset disposal agents. Further, the Guide- lines provide simplified application procedure as well as the requirements and conditions to be met by the procuring and asset disposal agents when applying for registration and licensing; and when applying for renewal of annual practicing license. The Guidelines and relevant forms can be accessed from the Authority’s website, www.ppra.go.ke.
The Authority brings to the attention of all stakeholders the operationalisation of this mandate through the Guidelines, and invites applications from interested and qualified persons to be registered and licensed as Agents from 1st July, 2022. A person applying for registration and licensing should specify the category of their interest per application and shall pay the prescribed fee for each category. The practice categories include:
- Procurement of: goods, non-consultancy services, consultancy services and works;
- Warehousing, Inventory and Asset Management;
- Logistics Management ;
- Contract Management;
- Assets Disposal;
- Procurement Audit and Compliance Review; and
- Procurement Transaction
