FOR THE SELECTION OF AN INDEPENDENT EXPERT FOR NAIROBI – NAKURU MAU SUMMIT HIGHWAY PPP PROJECT
TENDER NO: KeNHA/PPP/2934/2021
- The Government of the Republic of Kenya, through the Ministry of Transport, Infrastructure, Housing and Urban Development, represented by Kenya National Highways Authority (KeNHA) a state corporation established under the Kenya Roads Act, 2007 (hereinafter referred to as the “Contracting Authority”)/ jointly with Rift Valley Highway Limited (the “Project Company”), concessionaire of the Nairobi-Nakuru-Mau Summit Highway PPP Project (the “Project”), hereby invite sealed Bids from competent local and international firms or consortia (the “Bidders”) for the selection of an Independent Expert for the Project. The scope of work includes supporting the successful implementation of the Project through the provision of inter alia independent certification, review, monitoring, supervision of the Project during construction and operation period, approval of the invoices of the Project Company and mediation services such as under fast track dispute resolution for technical matters, in accordance with the terms and conditions of the Project Agreement executed between the Authority and the Project Company, the PPP Act 2013 and the PPP Regulations 2014, the details of which are provided under the RFP.
- A three-cover, single-stage open competitive bidding process has been adopted for the selection of the Independent Expert. Bidders can submit the completed Bids consisting of Qualification Documents, Technical Proposal and Financial Proposal under Cover 1, 2 and 3, respectively in pursuance of the Request for Proposal (the “RFP1”) and by demonstrating that they meet (or surpass) the requirements as defined under the RFP. Only Bidders who shall submit compliant Qualification Documents pursuant to the requirements set under the RFP shall have their Technical Proposal evaluated and assigned Technical Scores. Only Bidders with Technical Scores above the minimum required Technical Score shall have their Financial Proposal considered for opening and evaluation and further assigned Financial Scores. The Bidder who shall score the highest Combined Total Score i.e. aggregate of weighted Technical Score and Financial Score shall be declared as the Successful Bidder.

- The Bidders shall submit their Bids online through the link: https://www.kenha.co.ke/index.php?optionscom_formmaker&view=formmaker&id=36&Itemid=467 where Bidders will be expected to register prior to uploading their Bids and send copies to the email address specified in the RFP no later than 10:00Hrs (EAT), on 22nd April, 2021. Please note that the maximum size of document to be uploaded is 100MB for each cover. The Application shall be password protected and the said passwords shall be shared with the Contracting Authority and the Project Company in the manner as prescribed under the RFP.
- The Contracting Authority and the Project Company reserve the right to reject any or all Bids and terminate the Bidding Process at any time where it considers an award may not lead to benefit to the Contracting Authority or the Government of Kenya or the Project Company.
