THE DRAFT FERTILIZERS AND ANIMAL FOODSTUFFS (FERTILIZERS) REGULATIONS, 2021 

REQUEST FOR COMMENTS ON THE DRAFT REGULATORY IMPACT STATEMENT AND 

THE DRAFT FERTILIZERS AND ANIMAL FOODSTUFFS (FERTILIZERS) REGULATIONS, 2021

The Cabinet Secretary, Ministry of Agriculture, Livestock, Fisheries and Cooperatives is in the process of gazetting the draft Fertilizers and Animal Foodstuffs (Fertilizers) Regulations, 2021 as provided under Section 19 of the Fertilizers and Animal Foodstuffs Act Cap. 345.

In compliance with the provisions of the Fertilizers and Animal Foodstuffs Act and the Statutory Instruments Act No. 23 of 2013, the Ministry announces to the public the availability of the draft Fertilizers and Animal Foodstuffs (Fertilizers) Regulations, 2021 and draft Regulatory Impact Statement.

The main objective of the Regulations is to give effect to the provisions of the Fertilizers and Animal Foodstuffs Act Cap. 345 and the amendments of 2015 and to specifically regulate the importation, manufacturing, produc- tion, distribution and retailing of fertilizers and fertilizer raw materials; provide for the licensing of importers, manufacturers, producers, distributors and retailers in the fertilizer industry; prescribe the list of approved fer- tilizers and their standards; and provide for the inspection and analysis of fertilizers and fertilizer raw materials.

The Constitution of Kenya, 2010 and the Statutory Instruments Act, 2013 require the public to participate in decision making-process through submission of comments to the Ministry. All interested persons should submit written comments or memoranda on the Fertilizers and Animal Foodstuffs (Fertilizers) Regulations, 2021 and the draft Regulatory Impact Statement using the prescribed and downloadable Public Comments Feedback Form, to reach the undersigned not later than fourteen (14) days from the date of publication of this notice.

There shall be a public forum on Tuesday, 10th of May 2022 for invited stakeholders to discuss, receive com- ments and validate the draft Fertilizers and Animal Foodstuffs (Fertilizers) Regulations, 2021.
