REQUEST FOR COMMENTS ON THE DRAFT SEEDS AND PLANT VARIETIES (VEGETATIVELY PROPAGATING SEEDS) REGULATIONS,
2023 AND DRAFT REGULATORY IMPACT STATEMENT

The Cabinet Secretary, Ministry of Agriculture and Livestock Development is in the process of gazetting the draft
Seeds and Plant Varieties (Vegetatively Propagating Seeds) Regulations, 2023 as provided for under Section 3 of
the Seeds and Plant Varieties Act (Cap 326 of the Laws of Kenya).
The main objective of the Draft Regulations is to guide the development, promotion and regulation of Vegetatively
Propagating Seeds for the benefit of the growers and other stakeholders in the Vegetatively Propagating Seeds
sub-sector. The Regulatory Impact Statement contains independent detailed cost-benefit analysis, regulatory impact
and related information on the draft Seeds and Plant Varieties (Vegetatively Propagating Seeds) Regulations, 2023.
The Constitution of Kenya, 2010 and the Statutory Instruments Act, 2013 require the public to participate in the
decision-making process through the submission of comments on Government draft policies, draft Bills and Regulations
before they are published for implementation. In compliance with these provisions, Section 3 of the Seeds
and Plant Varieties Act (Cap 326), and the Statutory Instruments Act (No. 23 of 2013), the Ministry announces to
the public the availability of the draft Seeds and Plant Varieties (Vegetatively Propagating Seeds) Regulations, 2023
and draft Regulatory Impact Statement for scrutiny and feedback by way of comments.
All interested persons should submit written comments on the Seeds and Plant Varieties (Vegetatively Propagating
Seeds) Regulations, 2023 and the draft Regulatory Impact Statement using the public comments form, to reach
the undersigned not later than fourteen (14) days from the date of publication of this notice.
