PUBLIC NOTICE

THE STATUTORY INSTRUMENTS ACT (No. 23 of 2013) NOTIFICATION OF REGULATORY IMPACT STATEMENT

IT IS notified for the general information of the public that the Cabinet Secretary for Lands, Public Works, Housing, & Urban
Development in consultation with the Board of the National Construction Authority, pursuant to the provisions of section 8
of the Statutory Instruments Act, 2013, as read together with section 42(1), of the National Construction Authority Act No. 41
of 2011, has prepared the Regulatory Impact Statement on the impacts and likely impacts on the community of the National
Construction Authority (Amendment) Regulations 2023.
The main objective of the National Construction Authority (Amendment) Regulations 2023 is to reflect current best practices,
qualifications and standards in view of the developments in the construction industry. Specifically, the implementation of the
National Construction Authority (Amendment) Regulations 2023 will result in:
(a) Place more emphasis on experience-based evidence for registration whilst the previous criteria was document
based. This will enable the Authority to validate the technical competencies of applicants;
(b) Split civil works to road works and water works to underscore the technical differences in the two (2) sectors;
(c) Ungroup specialized works to two (2) classes of works; mechanical engineering services and electrical engineering
services, to provide a more comprehensive outline of the industry;
(d) Amend the value of construction works to reflect the current status quo in the industry in all the sectors. The
value of construction works under the building, roads and water sectors have been increased from the current
rates. Notably, the of construction works for the specialized works were adjusted downwards.
Any person who is likely to be affected by the proposed Amendment Regulations may submit a written memorandum on
the proposed Amendment Regulations within fourteen (14) days from the date of this notice. The memorandum should be

The draft Regulatory Impact Statement and the proposed National Construction Authority (Amendment) Regulations 2023
are available on the National Construction Authority’s website; www.nca.go.ke. The proposed Regulations and the Regulatory
Impact Statement are also available on request at the National Construction Authority Offices, 11th floor, KCB Towers Kenya
Road, Upper Hill Nairobi during working hours.
The date and location of the validation of the Regulatory Impact Statement and Draft National Construction Authority
(Amendment) Regulations 2023 shall be published via a separate notice.
